Injured Nascar Fans Contemplate Lawsuit

After 30 fans were injured at a race at the Daytona International Speedway speculations about potential lawsuits are brewing. The Speedway will likely argue that the event ticket forms a contract and all spectators assume the risk of objects coming into the stands. The fact that the ticket represents a contract, with a provision limiting liability, will likely be enforceable. It is expected that the plaintiff’s side will counter by attempting to demonstrate the existence of gross negligence on the part of the Speedway, due to failure to properly construct and secure a fence to protect fans from flying debris.
